In Canada and in the United States of America many, ARCHIVES, PRIVATE EDUCATORS,MAGAZINES, NEWSPAPERS, PRIVATE COLLECTIONS, AND PUBLIC LIBRARIES are very fond of claiming copy-right or owner ship of material over which they have absolutely NO legal claim.
One Bryant McGill is a perfect example: by claiming copyrights to works that were first published before 1923, long before Mr. McGill was even conceived,(one of Mr McGill's many-- chronic bad habits) he is guilty of BLATANT PLAGIARISM.

Artistic works (such as Paintings or poetry, Photos of the Klondike Gold Rush, for example); or photos of early territorial, Canadian, provincial, or municipal history; including original photos of historical buildings and news events, if published before 1923, are PUBLIC DOMAIN. The PUBLIC owns these works, not an archive, collector, individual, museum, or newspaper. 


Anyone can use public domain work without obtaining permission, but no one can ever again OWN it.


An archive, collector individual, etch. may place copyright protection on a historical collection as a whole ("COLLECTIVE WORKS"--if "ARTISTIC EFFORT" is involved) but the individual images or text still are not so copyrighted. Unfortunately, the term "ARTISTIC EFFORT" does provide a partial "loophole" that many LAW BREAKING/UNSCRUPULOUS, ACTUALLY CRIMINAL; archives, collectors, individuals, newspapers, and commercial web-sites attempt to take advantage of: VERY OFTEN SUCH PEOPLE WILL PROVIDE A LIST OF WORD DEFINITIONS, WRITE A REVIEW WHICH WILL USUALLY INCLUDE SOME SORT OF HISTORY, FACTUAL OR FICTIONAL, OR A SHORT STORY ABOUT THE AUTHOR, ARTIST, CREATOR, MATERIAL, PAINTING, PHOTOGRAPH, POEM, SONG, OR OTHER AND THEN CLAIM THAT THEY HAVE COPYRIGHT. AND SO THEY DO-- OF THEIR OWN , DEFINITIONS, HISTORY, REVIEW, OR SHORT STORY--OF THEIR OWN WORK ONLY. THEY DO NOT HAVE ANY "RIGHTS" TO ANY ORIGINAL WORK.

In the U.S., any work published before January 1, 1923 anywhere in the world is in the PUBLIC DOMAIN. Unmarked photos of historical buildings or events are also ALL PUBLIC DOMAIN.


Other countries are not necessarily bound to that 1923 date though. Complications can and do arise, when special cases are considered, such as trying to determine whether a work published later might be in the public domain in the U.S., or when dealing with unpublished works. When a work has not been published in the U.S. but in some other country, that countries copyright laws also must be taken into account.

A FURTHER BRIEF SUMMERY OF COPYRIGHT LAWS, AS THEY APPLY IN MOST CASES
  1. Anyone producing NEW material, of any type, automatically owns copyright on that new material.
  2. Two different people may produce-- a photograph for example-- use exactly the same equipment, take the photograph from exactly the same place, with exactly the same exposure, The photographs might NOT be significantly different; BUT, each will own their own COPYRIGHT.
  3. Any painting, photograph, image, sculpture, graphic, or other work of art that is on permanent, or semi permanent PUBLIC display may be photographed and the photographer then has copyright on "That" photograph.
  4. Anyone consigning for NEW material, of any type, automatically owns the copyright on that new material.
  5. Copyright extends for the remainder of the year in which it was produced, until the death of THE PERSON WHO ORIGINALLY PRODUCED IT, and for fifty years beyond the time of death.
  6. Copyright can be sold, but, it is still the original copyright. Selling does NOT produce a new copyright.
  7. If, and When,--only If, and When, the person having bought that copyright, producing New material, that is even slightly different from the original, a New copyright is produced.
  8. Copyright can NOT be BOUGHT OR TAKEN OVER, after the person owning that copyright is dead. Who could you buy the copyright from? 
  9. You can not just assume copyright of existing material, even if you are directly affected by that  material. YOU CAN'T GAIN COPYRIGHT OVER PUBLIC DOMAIN, AND YOU CAN'T ADMINISTER IT (CENSURE WHO MAY OR MAY NOT USE IT).
  10. According to United States of America COPY RIGHT LAWS: any material or photographs published "ANYWHERE IN THE WORLD" BEFORE THE YEAR 1923 (SOON TO BE UPDATED--MOVED FORWARD) ARE  PUBLIC DOMAIN.

  2. Robert W Service was the most commercially successful poet ever. It is not at all difficult to find information about him or his works; just search the name through your web-browser. I believe my posting is pretty much self explanatory. I thank you for your interest.
